These Terms and Conditions ("T&C") govern your access to and use of the website and services ("Platform") operated by FOMOGO TECHNOLOGIES PRIVATE LIMITED ("Company," "we," "us," or "our"). We are incorporated under the laws of India with our principal place of business in India.
Acceptance
By accessing or using the Platform, you ("User," "you," or "your") agree to be bound by these T&C, as well as any additional policies referenced herein, including our Privacy Policy and Refund/Cancellation Policy. If you do not agree to these T&C, you must not access or use the Platform.
User Categories
Our Platform caters to two primary categories of Users:
- Candidates: Individuals seeking to improve their interviewing skills and/or find employment opportunities.
- Companies: Organizations looking to hire pre-vetted talent quickly.
Age Requirement
The Platform is intended for Users who are at least 18 years old or the age of majority in their jurisdiction. By using this Platform, you represent that you meet this age requirement.
Modifications
We may modify these T&C at any time. We will notify Users of any material changes by posting the updated T&C on the Platform or through other appropriate communication channels. Your continued use of the Platform following the posting of changes constitutes your acceptance of such changes.

Services Overview
Platform Features
- For Candidates:
- Practice mock interviews and improve interviewing skills.
- Purchase credits to gain additional practice sessions.
- Get pre-interviewed and listed for Companies seeking pre-vetted candidates.
- For Companies:
- Access our pool of pre-vetted Candidates.
- Quickly hire Candidates who fit specific roles or skill requirements.
No Guarantee of Employment or Hire
We do not guarantee that Candidates will secure employment through the Platform, nor do we guarantee that Companies will successfully hire a suitable Candidate.
Candidate Terms
Registration & Account Creation
- Candidates must provide accurate personal information, including (but not limited to) name, contact details, resume/CV, job preferences, and any other information required during registration.
- Candidates agree to keep their login credentials confidential.
Mock Interviews & Recordings
- By participating in mock interviews, Candidates consent to the recording of such sessions.
- Recorded interviews may be shared with Companies for assessment and potential hiring.
Credit Purchases
- Usage-based pricing: Candidates can purchase a specified number of credits for interview sessions or other services.
- Payment processing: Payments can be made through our authorized payment gateways.
- All transactions are secured and processed in accordance with applicable payment industry standards.
Refunds
- Refund Window: Candidates may request a refund for any unused credits within 14 days of the purchase date.
- Partial Refunds: Pro-rated refunds for partially used credits may apply as specified in our Refund/Cancellation Policy.
Responsibilities
- Candidates are solely responsible for the content of their resumes, interview responses, and any other information they provide.
- It is the Candidate's responsibility to keep their profile information updated.
Company Terms
Registration & Account Creation
- Companies must provide accurate information regarding their legal name, registered website, number of employees, and any relevant employee data of individuals using the Platform.
- Each Company user (e.g., HR personnel, hiring managers) must have proper authorization within their organization to access and use the Platform.
Access to Candidate Data
- Companies may view Candidate profiles, resumes, interview recordings, and other relevant data for the sole purpose of evaluating Candidates for potential employment.
- Companies must handle all Candidate data in compliance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act), General Data Protection Regulation (GDPR), and California Consumer Privacy Act (CCPA), as applicable.
Hiring & Job Offers
- All hiring decisions are made independently by Companies. We are not responsible for the outcome of any hiring process or employment relationship initiated through the Platform.
Platform Access
- Access to the platform and its features is provided based on our current terms of service.
- Any changes to access terms or introduction of fees will be communicated in advance, requiring explicit acceptance before implementation.
General Use of the Platform (All Users)
Prohibited Conduct
You agree not to:
- Use the Platform in a manner that violates any applicable local, state, national, or international law.
- Engage in activities that may disrupt or interfere with the Platform's operation, or any User's enjoyment of the Platform.
- Upload or transmit any content that is unlawful, defamatory, or infringes any intellectual property rights.
Intellectual Property
- All materials, trademarks, logos, software, and content provided by the Company on the Platform remain the property of FOMOGO TECHNOLOGIES PRIVATE LIMITED.
- Users may not copy, reproduce, distribute, or create derivative works without our express written permission.
Disclaimer of Warranties
- The Platform is provided "as is" and "as available," without warranties of any kind, either express or implied.
- We disclaim all warranties regarding the accuracy, reliability, or completeness of any information provided on the Platform.
Limitation of Liability
- To the fullest extent permitted by law, FOMOGO TECHNOLOGIES PRIVATE LIMITED and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of (or inability to use) the Platform.
Indemnification
You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, liabilities, or expenses arising out of or related to your use of the Platform or breach of these T&C.
Termination
Termination by the Company
- We reserve the right to suspend or terminate any User account at any time for a variety of reasons, including but not limited to:
- Violations of these T&C.
- Fraudulent or illegal activities.
- Harassment or misuse of the Platform.
Effect of Termination
Upon termination, your right to access the Platform and its services will cease immediately. Sections regarding disclaimers of warranty, limitation of liability, and indemnification shall survive termination.
Governing Law & Dispute Resolution
Governing Law
These T&C are governed by and construed in accordance with the laws of India.
Jurisdiction
You agree that the courts located in India (with primary jurisdiction in the courts of Jorhat) shall have exclusive jurisdiction over any disputes arising under these T&C.
Additional Provisions
Severability
If any provision of these T&C is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall remain in effect.
No Waiver
Our failure to enforce any provision of these T&C does not constitute a waiver of that provision.
Entire Agreement
These T&C, along with the Privacy Policy and Refund/Cancellation Policy, constitute the entire agreement between you and the Company regarding your use of the Platform.
